وفي تقرير المقرر الخاص المعني بحالات الاعدام بلا محاكمة أو الاعدام بإجراءات موجزة أو الاعدام التعسفي خلص الى أنه منذ إنجاز لجنة التحقيق الوطنية لتحقيقاتها لم تبذل السلطات الاندونيسية أي جهد مؤسسي أو منظم للبحث عن مصير الموتى أو المختفين.

The Committee recommends that the State party take measures to amend the provisions of the Criminal Code with a view to ensuring that, as a minimum, acts and activities listed in articles 2 and 3 of the Optional Protocol are fully covered under its criminal law, no matter whether these acts are committed domestically, transnationally or on an individual or organized basis.

17. A second concern relates to the failure of the prosecution to put before the court evidence that portrays the killings and other human rights violations as part of a widespread or systematic pattern of violence against the population of Timor-Leste, which is a requirement for proof of a crime against humanity.
17 - وثمة داع ثان للقلق يتصل بإخفاق الادعاء في أن يقدم إلى المحكمة أدلة تصور أعمال القتل وغيرها من انتهاكات حقوق الإنسان باعتبارها جزءا من نسق واسع النطاق أو منظم من أعمال العنف الموجهة ضد سكان تيمور - ليشتي، وهو شرط من شروط أدلة وقوع جرائم ضد الإنسانية.

In paragraph 1 of resolution 1820 (2008), the Council stresses that sexual violence, when used or commissioned as a tactic of war in order to deliberately target civilians or as a part of a widespread or systematic attack against civilian populations, can significantly exacerbate situations of armed conflict and may impede the restoration of international peace and security.
ويؤكد المجلس في الفقرة 1 من القرار 1820 (2008) أن العنف الجنسي، حين يستخدم أو يوعز باستخدامه كوسيلة من وسائل الحرب لاستهداف المدنيين عمدا، أو في إطار هجوم واسع النطاق أو منظم ضد السكان المدنيين، قد يؤدي إلى استفحال حالات النزاع المسلّح إلى حد بعيد، وقد يعوق إعادة إرساء السلام والأمن الدوليين.
