(i) The notifier has received the written consent of the State of import; and

The Protocol requires that a document reflecting the coverage of the liability of the notifier or exporter shall accompany the notification referred to in Article 6 of the Convention.

1. The person who notifies in accordance with Article 6 of the Convention, shall be liable for damage until the disposer has taken possession of the hazardous wastes and other wastes.

The secretariat introduced the note on bridging information (UNEP/FAO/RC/CRC.1/11) that would be used by the Committee in judging the acceptability of a notification where the notifying country had used a risk evaluation from another country or international body.

Any additional information will facilitate decision-making by the Interim Chemical Review Committee. For the first two examples, where reported incidents occur in a country other than the country submitting the notification of final regulatory action the relevance to the notifying country should be described.

In the event that a country notified a final regulatory action to ban a chemical that had not been proposed for use in that country, submission of chemical-specific supporting documentation would assist the Interim Chemical Review Committee to establish that the final regulatory action was taken as a consequence of a risk evaluation of the anticipated or likely uses of the chemical in the notifying country.
