The negotiations with the implementing partner must be finished and the contract signed in the coming days.

(ii) Neither the carrier nor a performing party otherwise has actual knowledge of its contents before issuing the transport document or the electronic transport record; and
`2` ولم يكن الناقل ولا الطرف المنفّذ على علم فعلي بمحتوياتها من مصدر آخر قبل إصدار مستند النقل أو سجل النقل الإلكتروني؛

The shipper, on delivery of the goods to the carrier or to the performing party for carriage, is entitled to obtain from the carrier, at the shipper's option:

" Transport document " means a document issued under a contract of carriage by the carrier or a performing party that:

If the shipper fails to do so and the carrier or performing party does not otherwise have knowledge of their dangerous nature or character, the shipper is liable to the carrier for loss or damage resulting from such failure to inform; and
وإذا لم يفعل الشاحن ذلك ولم يكن الناقل أو الطرف المنفّذ على علم بطبيعتها أو خاصيتها الخطرة من مصدر آخر، كان الشاحن مسؤولا تجاه الناقل عن الخسارة أو الضرر الذي ينجم عن عدم الإبلاغ بذلك؛

(i) Neither the carrier nor a performing party weighed the container, and the shipper and the carrier had not agreed prior to the shipment that the container would be weighed and the weight would be included in the contract particulars; or
`1` لم يزن الناقل ولا الطرف المنفّذ الحاوية، ولم يكن الشاحن والناقل قد اتفقا قبل الشحن على أن توزن الحاوية وأن يدرج الوزن في تفاصيل العقد؛ أو

On request of the carrier or the performing party that delivers the goods, the consignee shall acknowledge receipt of the goods from the carrier or the performing party in the manner that is customary at the place of delivery.
يُقر المرسل إليه، بناء على طلب الناقل أو الطرف المنفّذ الذي يسلّم البضاعة، بتسلّم البضاعة من الناقل أو الطرف المنفّذ على النحو المتعارف عليه في مكان التسليم.

Nothing in this Convention affects a right of the carrier or a performing party that may exist pursuant to the contract of carriage or the applicable law to retain the goods to secure the payment of sums due.

Article 70. Actions against the maritime performing party
المادة 70- رفع الدعاوى على الطرف المنفّذ البحري

The plaintiff has the right to institute judicial proceedings under this Convention against the maritime performing party in a competent court within the jurisdiction of which is situated one of the following places:
يحق للمدّعي أن يرفع دعوى قضائية بمقتضى هذه الاتفاقية على الطرف المنفّذ البحري أمام محكمة مختصة يقع ضمن نطاق ولايتها أحد المكانين التاليين:

Subject to articles 73 and 74, no judicial proceedings under this Convention against the carrier or a maritime performing party may be instituted in a court not designated pursuant to articles 68 or 70.
رهنا بأحكام المادتين 73 و74، لا يجوز رفع أي دعوى قضائية بمقتضى هذه الاتفاقية على الناقل أو الطرف المنفّذ البحري أمام محكمة ليست معيّنة بمقتضى المادة ٦8

The second sentence of the text was intended to give protection to a secured creditor with higher priority than that of the enforcing secured creditor.
