On 2 November 1998 the family was visited by a man who informed them that Djilali Hanafi was being detained at the headquarters of the Mechraâ-Sfa gendarmerie.
وفي 2 تشرين الثاني/ نوفمبر 1998، زار رجل أفراد أسرته وأخبرهم بأن جيلالي حنفي محتجز في مقر وحدة الدرك في مشرع الصفا.

The complainant considers that this proves beyond any doubt to what extent the officers concerned were sure that the beatings inflicted on Djilali Hanafi while in detention would inevitably kill him.
وترى صاحبة الشكوى أن هذا يثبت بدون شك إلى أي حد كان أفراد الدرك على يقين بأن أعمال العنف التي ارتكبوها ضد جيلالي حنفي خلال احتجازه ستؤدي لا محالة إلى وفاته.

3.1 The complainant points out that Djilali Hanafi was subjected to extremely serious ill-treatment.

Another of his brothers and the complainant had been asked the same questions, followed by comments to the effect that Mr. Hanafi did not have the right to initiate such proceedings.

Lastly, the victim's brother learned that three of his cousins, who had been questioned by the Algerian secret services in a case unrelated to the complaint before the Committee, had heard that Sahraoui Hanafi was under surveillance.

2.5 After the victim's death, his family brought the case to the attention of the office of the public prosecutor working in the competent courts for their district, both civil and military, challenging the arbitrary arrest and torture followed by the death of the victim, to no avail.
