Possible defences to liability include war, hostilities, exceptional and irresistible natural phenomena, an act of a third party, compliance with a specific order or compulsory measure of a public authority or damage caused by pollution at " tolerable levels under local relevant circumstances or dangerous activity ... taken in the lawful interest of the person who suffered the damage " .
95 - ومن موانع المسؤولية الجائزة الحرب وأعمال القتال والظواهر الطبيعية الاستثنائية والتي لا مرد لها، وعمل الغير، والامتثال لأمر محدد أو تدبير جبري لسلطة عمومية أو ضرر ناجم عن التلوث ' ' بمستويات مسموح بها في الظروف المحلية ذات الصلة أو نشاط خطير يجري لمصلحة مشروعة للشخص الذي لحقه الضرر``().

Furthermore, under articles 51, 53, etc., of the draft statute, all States parties or those States parties which have accepted the jurisdiction of the International Criminal Court will have the compulsory obligation to produce evidence, carry out an arrest or a detention or transfer an accused, in the case of genocide or any other crime, respectively.
