104. Some support was expressed for the replacement of the phrase “is not in conformity with” by “does not comply with” or some other phrase referring to non—compliance or breach.
104- وأُعرب عن شيء من التأييد للاستعاضة عن عبارة " غير مطابق " بعبارة " غير ممتثل " أو بعبارة أخرى تشير إلى عدم الامتثال أو الخرق.

2. Rather than the term “not in conformity with”, the term “does not comply with” is preferred, on the ground that it is more comprehensive and more apt to cover breaches both of obligations of specific conduct and obligations of result.
٢ - يفضل استخدام عبارة " غير ممتثل ﻟ " بدلا من عبارة " غير مطابق ﻟ " ، على أساس أنها أكثر شمولا وأكثر قابلية لتغطية انتهاكات كل من الالتزامات بسلوك معين والالتزامات بنتيجة.

The main areas that require action before the Commission will be in a position to report to the Security Council that Iraq is in substantial compliance with its obligations remain as follows:

٢ - يقرر أن ذلـك الرفـض للتعـاون يشكـل انتهاكـا صارخـا لقرارات مجلــس اﻷمــن ٦٨٧ )١٩٩١(، و٧٠٧ )١٩٩١(، و٧١٥ )١٩٩١(، و١٠٦٠ )١٩٩٦(، ويلاحظ أن اللجنة الخاصة لم تفد في تقرير رئيسها التنفيذي بأن العراق ممتثل الى حد بعيد ﻷحكام الفقرتين ٢ و٣ من القرار ١١١٥ )١٩٩٧(؛

(ii) if the applicant is a subsidiary of another entity, copies of such financial statements of that entity and a statement from that entity in conformity with internationally accepted accounting practices and certified by a duly qualified firm of public accountants that the applicant will have the financial resources to carry out the plan of work for exploration;

The representative of Oman stated that his country had successfully concluded projects reducing consumption of ODS, and that it was in compliance with the Protocol. He requested the deletion of Oman from the list of Parties included in the first draft decision.
100- أفاد ممثل عُمان بأن بلده قد أنجز بنجاح المشاريع الرامية لخفض استهلاك المواد المستنفدة للأوزون، وبأنه ممتثل للبروتوكول، وطلب شطب عمان من قائمة الأطراف المتضمنة في مشروع المقرر الأول.
