(a) It must be a Libyan family consisting of a husband and wife who are committed to sound principles of morality and are capable of providing an appropriate environment for the foster child. Neither of the spouses should be over 50 years of age and the family's economic status must be such as to ensure the foster child's basic needs throughout the period of fosterage;
(أ) أن تكون الأسرة ليبية مكونة من زوجين ملتزمين بمبادئ الأخلاق الحميدة وقادرة على تهيئة الظروف المناسبة للمكفول ولا يزيد عمر أي من الزوجين على خمسين عاماً، وأن تسمح حالة الأسرة الاقتصادية بإشباع الحاجات الضرورية للمكفول طوال فترة الكفالة؛

This type of bequest is defined in article 315 as " a bequest enabling a person who is not entitled to inherit to acquire a specific share of the estate of the testator " , which is unquestionably in the interests of the foster child.
وعرف القانون في المادة 315 التنزيل بأنه " هو وصية بإلحاق شخص غير وارث بميراث الموصى وبنصيب معين في الميراث " ولا شك أن في ذلك مراعاة لمصلحة الطفل المكفول.

This approach does not differ greatly from that of adoption save with regard to the right to take the family's name, the right to inherit and other matters related to the family's natural children. وهذا اﻷسلوب لا يختلف كثيرا عن أسلوب التبني إلا في حالات حق الانتساب لاسم اﻷسرة وحق اﻹرث وما إليها من اﻷمور التي ترتبط بالابن الطليعي لﻷسرة ويواجه أسلوب الكفالة عدة صعوبات منها أن الطفل المكفول يظل يحمل اسما ولقبا مخالفا لاسم ولقب اﻷسرة التي تكفله، وقد حاولت مذكرة حماية ورعاية الطفولة التي أقرها مؤتمر الشعب العام من خلال المبدأ الرابع عشر حل هذه اﻹشكاليات والصعوبات.

290. The State of Kuwait pays attention to the care of children born out of wedlock and to the treatment of this underprivileged group. Thus, the Foster Family Code No. 82 of 1977 was enacted to encourage families to take children of unknown parentage into their full custody. The Code, however, provides for the supervision of this process by the Ministry of Social Affairs and Labour so as to protect the rights of the foster child.
290- حرصت دولة الكويت على رعاية الأبناء غير الشرعيين، ونظمت طرق التعامل مع هذه الفئة المحرومة، فقد قامت بإصدار قانون الحضانة العائلية رقم 82 لسنة 1977 الذي يهدف إلى تشجيع الأسر على رعاية وتنشئة الأطفال مجهولي الوالدين رعاية كاملة تحت إشراف وزارة الشؤون الاجتماعية والعمل بما يضمن حقوق الطفل المحتضن.
